2024 ANNUAL REPORT
ANTELOPE HEIGHTS METROPOLITAN DISTRICT

As required by Section 32-1-207(3)(c), C.R.S. and Section VII.D of the Service Plan of Antelope Heights Metropolitan District (the “District”), approved September 16, 2002 by the Town Council of the Town of Parker (the “Town”) the following report of the activities of the District from January 1, 2024 to December 31, 2024 is hereby submitted.

A.              Boundary changes made: The District did not change its boundaries in 2024.

B.              Intergovernmental Agreements entered into or terminated: The District did not enter into or terminate any Intergovernmental Agreements in 2024.

C.              Access information to obtain a copy of rules and regulations adopted: The District has not adopted any rules or regulations as of December 31, 2024. In the event the District adopts rules or regulations in the future, such documents may be accessed at the offices of CliftonLarsonAllen, LLP, 2001 16th Street, Ste. 1700, Denver, CO 80202. D.              Summary of litigation involving the District’s public improvements: None of the District’s public improvements were involved in litigation in 2024.

E.               Conveyances or dedications of facilities or improvements, constructed by the District, to the Town: The District did not convey or dedicate any facilities or improvements to the Town in 2024.

F.               Notice of any uncured events of default by the District, which continue beyond a ninety (90) day period, under any debt instrument: To our knowledge, there are no uncured events of default by the District which continue beyond a ninety (90) day period.

G.              Any inability of the District to pay its obligations as they come due, in accordance with the terms of such obligations, which continues beyond a ninety (90) day period: To our knowledge, the District has been able to pay its obligations as they come due.

H.              A narrative summary of the progress of the District in implementing its Service for the report year: District implementation of the Service Plan is proceeding as planned and as approved by the Town. The District has completed and received final acceptance of all infrastructure improvements.

I.                Audited financial statements of the District for the report year including a balance statement as of December 31 of the report year and the statement of operations for the report year: A copy of the 2024 Audit is not yet available and the 2023 Audit is attached here.

J.                A summary of the capital expenditures incurred by the District in development of public facilities in the report year, as well as any capital improvements or projects proposed to be undertaken in the five (5) years following the report year: A summary of the capital expenditures incurred by the District in development of public facilities is included in the 2024 Audit.

K.              A summary of financial obligations of the District as of December 31, 2024:

i.       Amount of outstanding indebtedness – $9,575,335 comprised of:

•        $5,865,000 General Obligation (Limited Tax Convertible to Unlimited Tax), Refunding and Improvement Loan Series 2017A;

•        $1,610,335 General Obligation Bonds (Limited Taxable Convertible to Tax Exempt), Refunding and Improvement Loan, Series 2017B;

•        $1,901,044 General Obligation Bonds (Subordinate Limited Tax General Obligation Bonds Series 2021B(3) (includes principal and interest balance)

ii.       The amount and terms of any new District indebtedness or long-term obligations issued in the report year: $0

iii.     The amount of principal payment or retirement of the existing indebtedness of the District in the Report Year: $660,000

iv.      Total assessed valuation of all taxable properties within the District during the report year: $24,264,950

v.        Current Mill Levy of the District pledged to debt retirement in the Report Year: 40.000 mills

 

L.               The District’s budget for the report year: A copy of the District’s 2025 budget is attached here .

M.             A summary of residential and commercial development in the District for the report year: The District does not receive Certificates of Occupancy information from the Town and is required to submit an Open Records request to the Town in order to report this information. As such, it is not included in this report. There was no commercial development in the District during 2024.

N.              A summary of all fees, charges and assessments imposed by the District as of January 1 of the report year: The District has a system development fee of $3,000 per residential property unit and $0.25 per square foot for commercial properties. No system development fees were received in 2024.

O.              Certification by the Board that no action, event or condition enumerated in Section 10.11.060 of the Parker Colorado Municipal Code, as amended, has occurred in the report year: On behalf of the Board of Directors, I certify that no material modification, action, event or condition enumerated in Section 10.11.060 of the Parker Colorado Municipal Code, as amended, has occurred in the Report Year.

The District has scheduled 2025 regular meetings for: November 3rd at 6:00 p.m. and the annual meeting for November 3rd at 6:00 p.m. to be held virtually via Microsoft TEAMS.

HB23-1105 Metro District Task Force Notice 

Notice Concerning HB23-1105: Homeowners’ Association and Metropolitan District Homeowners’ Rights Task Forces

 

Pursuant to House Bill 23-1105, signed into law on May 24, 2023, a Metropolitan District Task Force is to be appointed by November 1, 2023, to examine issues regarding homeowners’ rights and to perform other duties as noted in the new law. A summary of the Bill and link to the signed Act are available at https://leg.colorado.gov/bills/hb23-1105. Each Metropolitan District in Colorado created to finance infrastructure to support a housing subdivision is required to notify its residents about the task force.
